The New Patriotic Party has dragged the Attorney-General to the Supreme Court seeking a definitive interpretation of the constitutional provisions on presidential tenure in Ghana. In a writ dated July 30th, 2026, filed under Articles 2(1) and 130(1) of the 1992 Constitution, the party is praying the apex court to declare that the two-term limit applies to the total number of terms served, whether consecutive or not, and that no person can be elected President for more than two four-year terms amounting to eight years in total.

The party further wants the court to clarify that a person who has already served one presidential term is eligible to contest for only one more term, regardless of whether that earlier term immediately preceded the current contest or was interrupted by another President’s tenure.

The NPP is also seeking interpretation of the provisions governing a Vice-President who assumes office for more than half of a predecessor’s unexpired term, asking the court to declare that such a person can only contest for one additional term. The suit relies on Articles 58(2), 60(6) and (7), 63(2) and 66(1), (2) and (3)(a).In its statement of case, the NPP describes itself as a major stakeholder in Ghana’s democracy and says the action has become urgent to safeguard constitutional principles and preserve national peace, arguing that allowing a former one-term President to serve two more terms after a break would amount to inserting words into the Constitution and undermining constitutionalism and the rule of law.
