Key Developments

Formal Notice: This dissent emerged after Parliament formally notified the Electoral Commission (EC) on Monday, December 8, 2025, that the seat had become vacant. This action was taken to comply with a High Court judgment mandating a re-election in that constituency.

Official Communication: In an epistle dated December 4, 2025, the Clerk of Parliament, Ebenezer Ahumah Djietror, informed the EC Chairperson, Jean Mensa, that the seat was empty in accordance with the judicial decision rendered on November 24, 2025.

Legal Background: The matter, where the Clerk was designated as the fourth defendant, stemmed from a litigation concerning the previous poll in the Kpandai constituency (Case Reference NR/TL/HC/E13/22/25).

Minority’s Stance and Action

Chief Whip’s Condemnation: Speaking on Tuesday, December 9, 2025, Minority Chief Whip Frank Annoh-Dompreh criticized the communication, labeling it as “inappropriate” and “regrettable,” further adding that it breached the supremacy of law.

Demand for Retraction: He stated, “Mr. Speaker, there is a missive that was sent into the House to declare the Kpandai seat empty. That missive is inappropriate, regrettable, and goes against the supremacy of law. We firmly contend that the missive must be recalled by Parliament. We in the Minority will not assent to the composition of this missive.”

Protest: Subsequently, Minority members, attired in black garments, chanted nationalistic tunes in objection to the determination and jeered at the Clerk of Parliament, Ebenezer Djietror, when he attempted to restore order.
