A private legal practitioner is preparing to take legal action against the Minerals Commission over alleged illegal mining activities at the Prestea-Bogoso Mine.
According to information gathered, the lawyer intends to challenge what is described as the Commission’s failure to effectively regulate and prevent unauthorized mining operations within the legally acquired concession of Heath Goldfields.
The suit is expected to raise concerns about environmental degradation, regulatory oversight, and the protection of state resources.
Sources indicate that the legal action will argue that illegal mining—commonly referred to as “galamsey”—continues to thrive in parts of the Prestea-Bogoso enclave despite existing laws and regulatory frameworks.
The case is also expected to question whether the Minerals Commission has fulfilled its statutory mandate to supervise and manage mineral resources in the national interest. Workers of the mine have raised concerns of their safety while they co-exist in the underground mine with illegal miners.
According to the Lawyer, he has cited a letter from Heath Goldfields titled ” *Urgent Security Breach and Armed Occupation of Heath Goldfields Concession at Prestea*” addressed to the Western Regional Minister and copied the Minerals Commission as regulators among other people. This security breach continues to linger and affecting the safe operations of the Underground Mine. According to the Lawyer, all persons mentioned in the said letter including Karim Salifu, Muhammed Awal, Benjamin Ayensu, Emmanuel Ackah, Mutala Mohammed and Abdul Latif must be brought to book.
If filed, the lawsuit could have significant implications for regulatory enforcement and accountability within Ghana’s mining sector, particularly in areas heavily affected by illegal mining activities.
